My stepson has two siblings from his mother that have been in foster care for 13 months. They were taken away from her due to her drug use. My question is what are the chances of her getting these kids that or will they be adopted out? She was supposed to complete inpatient rehab but she keeps refusing. How long will children’s services give her to complete this? We are in Ohio this helps.
The children are 1 1/2 and 3 1/2 years old.

Depending on the state (some are more strict) and the age of the kids & whether they have an adoptive placement lined up…I would guess sometime in the next 3-6 months they will start pushing for permanency.

Federal law states that children who are in foster care for 15 out of 22 consecutive months may be released for adoption. There are a few exceptions, but that’s the general rule. Your relative is potentially only a couple of months away from getting her parental rights terminated. Since the children are so young and highly adoptable, I’d be surprised if they cut her any slack.
