How Long to Get Hearing for Parole Violation in NY?
Question by ericalynn429: How long to get hearing for parole violation in NY?
My fiance violated parole and was arrested this morning. My son and I are hysterical and have no idea what to expect.
My fiance was arrested in 2003 for armed robbery. He was 16. He was released on parole in november of 2007. He has had the same job for almost 3 years, we had a son together, and we had our life pretty much on track. However in october he was caught smoking weed and was arrested. They dropped the charges but his parole officer made him go to a rehab program. A few months later he tested positive for marijuana. He was given a warning. His parole officer has been great and has tried to work with him. Obviously, he never got the wake up call.
Today he was arrested for failure to report to parole. They had a k-9 search my house. They found 3 grams of weed and a bong. Im assuming this is a new charge? I was told he will have a hearing to determine what will happen in a few weeks. Is this correct or could i be waiting months just to find out what will happen?
I was not with him when he was previously in jail. I have never gone through anything like this and am devistated. My son keeps crying for his dad, and im left here alone trying to keep it together.
Please no negative comments. Im just trying to learn as much as i can. Thanks

I wish you and your son well. This will be very emotional for you both. I suggest you find out how to get visitation rights while your boyfriend is detained. Don’t take your son the first time, and then the 2 of you can decide when you should take him, if at all.
I don’t know how long it will take for your boyfriend’s hearing. I can tell you that it ended up taking 8 months for my brother’s hearing in Cleveland, OH in 2005, but part of that delay was caused by his lawyer.
Hopefully, your boyfriend will wake up this time. As far as the drugs found, they could bring a new charge or they might just violate him. You didn’t say how long he still faced. My brother went back to prison for another 34 months. And then started parole of 5 years! He’s finally done and hopefully won’t ever be in court again.
Good luck to you and your son. Hopefully, you can keep a relationship with your boyfriend. But don’t listen to bull from him and decide what is best for you and your son.
